Hall of Fame quarterback Dan Marino has filed his own NFL concussion lawsuit. Travis Fulgham Jersey . Marino, along with 14 other players, filed the lawsuit on May 28 in the U.S. District Court for the Eastern District of Pennsylvania. Marino joins a little under 5,000 retired NFL players and their families that have sued the league across approximately 225 concussion lawsuits. There have been many notable players that have filed lawsuits, including Tony Dorsett, Eric Dickerson, Mark Rypien, Tony Mandarich, Art Monk, Jim McMahon and Jamal Lewis, as well as the estate of the late Junior Seau. None, however, are as well known as Marino. The key allegation raised by Marino is the NFL concealed information. He is arguing that the NFL knew of the long-term neurological impact of headshots but failed to share those findings with the players. This issue of fraudulent concealment was also alleged in the other concussion lawsuits so its not new. Its tough to know if Marino will succeed as everything turns on the evidence presented at trial. To win, he will need to show that the NFL had key and important information about the long-term and devastating impact of headshots and concealed it. The NFL, however, has certain defences available to it. First, it can argue that players were aware of the risk associated with playing football and they agreed to those risks each time they stepped onto the field. The NFL would also maintain that they didnt conceal anything. As well, the NFL could point out that no one can say for sure what caused a players dementia, and even if it was caused by repeated headshots while playing football, how much of that damage was sustained outside the NFL in places like college or high school ball. So what caused the dementia and when it was caused become key issues. The NFL can also argue that Marinos lawsuit doesnt belong in court in the first place, but rather should go to arbitration. The collective bargaining agreement provides that issues of player health and safety go to arbitration and not court. On the flip side, Marino would argue that since this case involves fraud in the form of concealment, it properly falls outside of arbitration and within the jurisdiction of the courts. Bottom line is this: both sides face challenges in this case and thats where we generally see settlement. All this is probably moot, as the league is working on finalizing a global settlement of these cases. You may recall that back in July 2013, the league announced it had settled the concussion lawsuits with the players. The negotiated settlement was for $765 million and would bind every retired NFL player, of which there are about 19,000. You should note, though, Marino is included among these players. So that means that Marino didnt need to file the lawsuit at this time. As well, while settlement was indeed announced, it was not finalized. Before the NFL can consider the case closed, the Court has to approve the terms of settlement. The problem is that on two separate occasions the Court has rejected the settlement on the basis that there is insufficient money to pay all players. As well, even if the Court were to approve the settlement, any of the 19,000 players would have the option to opt-out of the settlement agreement. If a player believes that he can do a lot better filing his own individual lawsuit, he would tell the court and the NFL thanks but no thanks, Im headed to court. The Marino lawsuit may suggest that he is tired of waiting around for a payout from the proposed settlement and wants to take matters into his own hands. Whatever Marinos motivation, these concussion lawsuits are likely to continue for years. In the event a global settlement is approved by the Court, it seems likely that a number of players will opt out and file their own lawsuits. Indeed, there is still a lot of track to cover. But to what extent does all this extra play time affect the officials? How much do they feel the physical and mental fatigue caused by a game heading into its second or third overtime period, and is this related to the perception - real or imagined - that officials tend to "swallow their whistles" in OT? Best,Mark Hill Mark: Fatigue was much more of an issue to contend with in the one referee system when we chased the play from end to end and didnt get much of an opportunity for a rest. A refs best friend can be a moving puck. Whenever possible, I attempted to force players to "move it"! Aside from enhancing the entertaining value of the game another upside of sustained action was that players gave and received hits with less likelihood of retaliation and scrums developing. On occasion I wore a heart monitor and during three to five minute runs without a whistle the readings would be sustained between 165-175 bpm.  By comparison the highest my heart rate ever got in the two referee system was 98 bpm. There should be no reason (in the two-ref system) where physical fatigue might negatively impact the decision making process for an official regardless how many overtime periods are played. The mental aspect of a referees performance is a whole different kettle of fish! While players dont want to become the "goat" by making a bad play or mistake, the referees internal struggle is all about rendering a decision that might be perceived as a game ending bad call. (You notice I said perceived.) The best remedy in dealing with this pressure is for the official to maintain a rock solid focus of concentration by remaining in the moment and react to call penalties whenever they occur. Once a ref stops refereeing and puts his whistle away he becomes a spectator instead of an enforcer of the playing rules.  Each referee can feel intense pressure to make sure any call he makes is viewed as a "must call" in the late stages and overtime. The referees best work is done well in advance of the late stages of a game by maintaining the expected standard of enforcement and to keep the players in check throughout the entire game. C.J. Moore Jersey. The best deterrent against infractions being committed is "fear" a ref can instill in players that he will call the penalty whenever it is committed. When that is achieved players tend to play much more disciplined. The onus is placed more squarely on the players not to commit infractions once the referees enforce the rules more consistently and when expectations are met. I notice a difference in these playoffs as to which referees the players respond to and those they take full liberties with. Once the penalty standard slides and obvious infractions are let go it is extremely difficult for the referee to make a call in the late stages unless it involves a scoring opportunity, a puck over the glass or a major infraction. At times such as this the referee crew become spectators and fly on a wing and a prayer in hopes that the players will not do something really stupid that might force a call.  If the referee chooses to turn his whistle into a fossil the worst thing he can do is upset the apple cart with a penalty call that doesnt have a direct bearing on the play or is of less quality than what he previously has let go. We saw a prime example of this with fewer than two minutes remaining in Game 4 of the Habs-Lightning series. While it is difficult to deny that the trip by Cedric Paquette on Michael Bournival was a legitimate foul, given the countless infractions that were not penalized, the referee(s) were subjected to justifiable ridicule for calling a trip in the corner of the rink at that time of the game.   It is important to note there have been some real solid performances by the zebras in games thus far. The officials we notice most however are ones that stop refereeing the game and employ a standard of enforcement that resembles shifting sand. This isnt a result of fatigue; physical or mental. There is an answer to this dilemma. The referees have to be given clear direction by the Officiating Management to know and maintain the expected penalty throughout the entire game. In this regard the officials need to be better coached and held accountable when the expected standard is not met. Finally, when the officials do the job and make the tough calls they need to know they will be supported. DALLAS -- Dallas Stars centre Cody Eakin skated the length of the ice, got around a sliding defender, closed his eyes and shot just before his stick got ripped out of his hands. Kluber (14-9) allowed an unearned run, struck out eight and walked none in his third big league complete game -- all this season. He had been 0-3 in four starts since winning at the New York Yankees on Aug. 9 and in his previous start allowed a career-high three homers in a 12-1 loss to Detroit on Monday. The right-hander, who has carried the Indians all season, wasnt concerned about his recent problems. "Ive always tried to take the ball every fifth day when its your turn and pitch as long as you can," he said. "Hopefully thats why you do all that work between starts so when you get late in the season youre not wearing down." Manager Terry Francona has no worries about his ace. "His tank looks as full as its ever been," he said. Third-place Cleveland closed within five games of first-place Kansas City in the AL Central. The Indians are four games back of Seattle, which played later Saturday, for the ALs second wild card. The Indians lost three of four to Detroit coming into this series, but have bounced back with two straight wins. "Thats the only choice we have right now to put the past behind us," Kluber said. "Whatever happened the night before doesnt have any bearing on the next game." White Sox starter Jose Quintana allowed one run and seven hits in six innings, struck out seven and walked one. With the score 1-1, Michael Bourn walked with one out in the seventh against Zach Putnam (4-3) after fouling off a pair of full-count pitches and scored when Ramirez tripled off the wall in right-centre. Four pitchers later, Ramirez came home on Michael Brantleys single. Chicago, which has lost 13 of 17, threatened when Conor Gillaspie singled with one out in the ninth. After rumours a deal between the Los Angeles Dodgers and San Diego Padres for Matt Kemp may not get done due to a concerning physical, the two teams finally made the deal official late Thursday night. The Dodgers acquired catcher Yasmani Grandal, pitcher Joe Wieland and minor league hurler Zach Eflin from the Padres for Kemp, backup catcher Tim Federowicz and cash considerations. Los Angeles is believed to be sending the Padres $32 million towards the remaining $107 million Kemp is owed on his contract, which runs through 2019. According to a report from USA Today, the Padres were considering whether or not to finalize or void their agreed-upon trade for Dodgers slugger Kemp due to results over the outfielders physical. Sources told USA Today that Kemps physical revealed arthritis in both of his hips, with the Padres still trying to determine whether the condition will impact the remainder of the 30-year-olds playing career. Kemp has been hampered by hamstring issues in two of the last three seasons, missing 51 games in 2012 and 73 in 2013. He has to set up his entire off-season and his cap room by knowing how much these guys will make. Hes optimistic that these deals will get done shortly between now and July 1. Dreger: Yes, very soon news will break that Bob Nicholson is jumping into the National Hockey League. The NHL GMs discussed the draft lottery and possibly changing the odds, but is there no consensus just yet? LeBrun: Well it was sort of a confusing day. We spoke to Tim Murray of the Buffalo Sabres who said he was relieved, because he has three first-round draft picks in 2015 and his understanding is there wont be changes to the lottery before then. Antonio Gates Jersey . - The Detroit Tigers will start the season without Jose Iglesias, though just how long the injured shortstop is sidelined will not be known until after he sees a foot and ankle specialist on Tuesday. General manager Dave Dombrowski announced Sunday that Iglesias will start the season on the disabled list because of painful condition in both shins that affects him when he tries to decelerate. Iglesias will see Dr. Thomas Clanton of the Steadman Clinic in Colorado on Tuesday, and could possibly see another doctor after that, though Dombrowski did not say who that may be. "Weve done a lot of different tests, hes seen a lot of different doctors," Dombrowski said. "Weve sent his information to a lot of doctors. A lot of times, the analysis changed. However, the pain has not disappeared from him." Iglesias, acquired from Boston in a three-team trade, is considered a potential Gold Glove defensive infielder. Dombrowski said the 24-year-old Iglesias dealt with the same injury last season, but it did not get better over the off-season and it has bothered him more this spring. Both Dombrowski and manager Brad Ausmus said they had neither heard of, nor seen, a player experience this type of injury. What makes it so frustrating is that Iglesias can do a lot of physical activity without pain. "If you asked him to go take batting practice right now, or take infield, you would not even be able to really tell there is a problem," Dombrowski said. "But it hurts him when he starts to stop running." Ausmus said he noticed there was something wrong with Iglesias during the teams spring opener against Atlanta on Feb. 26. Iglesias hasnt played since. "I could tell when he ran something was bothering him," Ausmus said. ". Almost like he was running on glass." There has been speculation Iglesias could miss significant time, but Dombrowski said there is simply no way to tell how long the shortstop will be out until the true nature of the injury is diagnosed. Dombrowski did not completely rule out the possibility of making a move. He said he had already heard from two teams once word about the potential seriousness of Iglesias injury broke but plans to look at three internal candidates to fill the shortstop spot: Eugenio Suarez, Hernan Perez and Danny Worth. With so much on the line, no team came close to proving why they deserved to win it. Fittingly, the record books will show it as a draw: A stalemate in every sense of the word. It was a chess match where both players didnt make moves for long stretches. Just when it looked like either of them could capture their queen, along came two of the best pawns on the board. It was Javier Mascherano vs. Ron Vlaar. Both players were magnificent for their team but their standout performances said a lot about the oppositions weaknesses. Argentina have been waiting for a player to step up to a level that Lionel Messi has been at during this World Cup, but on a night when their current captain didnt get close to that level, their former skipper stepped up with an absolutely immense performance. Mascherano sat deep, allowed the defenders to play deep as well and flat out refused the Dutch any space in front of them. It forced their opponents to play long balls to try and get Arjen Robben and Robin van Persie into the match. No one could argue that the Dutch team needed Klaas Jan Huntelaar but for a game that looked so destined for penalties, the removal of the Manchester United striker could be questioned. What definitely needs to be questioned is the order of the penalty takers for the Dutch. It was clear that van Gaal wanted to keep as many of his players in the same spot as they were used in the shootout victory over Costa Rica. That day the Dutch went four-for-four in order: van Persie, Robben, Sneijder, Kuyt. Huntelaar was the fifth taker but wasnt used. Against Argentina, van Gaal looked at his team and knew the only one he had to replace was van Persie at number one. Every credit to Ron Vlaar, the Aston Villa player, to step up and replace van Persie in the shootout but making him the first shooter was the wrong decision. Argentina tried to force things wide but ultimately they were drawn back centrally and Vlaar, in the middle of the back three, won every tackle and aerial duel he went for. After 120 minutes, though, his job was not done. Showing nerves, he stepped up quickly, from the prompt of the whistle, and it wasnt a good penalty. The moment Vlaars effort was saved by Sergio Romero the momentum changed. Lionel Messi was the right choice for Argentina to take the first penalty and, to no ones surprise, he scored. Messi had struggled throughout the game, which was the first World Cup game he has played when he didnt get a touch in the opponents penalty area. It was clear the Dutch had done their homework and their mandate was to shut down Messi. He will receive his fair share of criticism based on this performance but, once again, this match was another shining example of how much he needs his teammates to take him to glory. The Barcelona man has carried Argentina to this stage, it is only fitting that some - in this case Romero, Mascherano and the rest of the shooters - helped carry him to the final. They are, however, a team that arrives in the final with flaws. This is nothing new. Many teams have reached the World Cup Final when not playing very well but few have won it. Argentina showed a lot of grit and fight in this semifinal, just like they did in the 120 minutes against Switzerland and the narrow 1-0 defeat over Belgium. However, despite their fight they do look very ordinary. They arrive in the final after scoring just two goals in three knockout matches. The Raptors had eight players with three or fewer years NBA experience last season, including keepers Terrence Ross, Patrick Patterson, Greivis Vasquez and Valanciunas. Do they really need to get younger? The Raptors are in a delicate place. Riding the Drake-era wave is essential for an organization with just one playoff series victory in its 20-year history. Packaging the pick with grease like Tyler Hansbrough, Landry Fields and/or Chuck Hayes might fetch a more dynamic piece that helps take better advantage of their window. Watson: I do what I do best: fleece the other GMs in the league with it for a good trade. Jonas Valanciunas and Terrence Ross are big parts of this ball club, but will only be entering their third seasons. The Raptors need a veteran who can contribute right away. They were one shot away from the second round of the playoffs. This team does not necessarily need to get younger. I only make the pick if Tyler Ennis or Nik Stauskas are still available, of course. Steve Kerr has been the coveted new coach this off-season. Will he continue a current trend of new blood in the NBA coaching ranks, or will we see a number of recycled coaches get jobs this summer? Strickland: Depends on situation and circumstance. Analytics rule the day for many teams and analysts like Kerr have gotten their coaching stripes without coaching experience (see: Jackson, Mark - Golden State). Young teams will need a veteran coach with a younger staff to relate to the ever changing National Basketball Association and its players while implementing structure, accountability and professionalism, as well as having the foresight to know when to let your horses be horses. Lionel Hollins, Nate McMillan, George Karl, Sam Mitchell and the aforementioned Jackson immediately come to mind. Older teams in soon-to-be rebuilding modes may need younger, less experienced coaches willing to take lumps while losing and learning on the job. Does that mean that Floridas Billy Donovan or UConns Kevin Ollie are going to leave cushy college gigs for the bright lights and finely finished hardwood courts of the NBA? Stay tuned! Head coaching hires are as much about stop-gapping and finances as they are about optics and competing. If Mark Jackson has taught us anything at all, its that the line between his first-stint firing from a 51-win playoff Warriors team and Karls coach of the year winning fifth-stint firing from a 57-win Nuggets postseason squad a year ago, is severely blurred. Watson: Enough already with retreads. Mike Dunleavy and George Karl havent won anything. If youre a successful coach like the Van Gundy brothers fine, but dont hire by name alone.
